In our practice, we work to protect the rights of students in matters such as disciplinary proceedings, freedom of speech, due process, and discrimination. Other representative matters have included representation of students in disputes with schools over issues such as school attendance, grading, and access to educational resources.

Special Education Law

At Farrell Lavin, we champion families of students with special needs in disputes regarding the development and implementation of Individualized Education Plans (“IEPs”) and similar programs under §504 of the Rehabilitation Act of 1973. Each matter is different and may involve accommodations in school or with standardized testing, out-of-district placement, short and long-term absence from school and home and hospital services. In either case of eligibility, no discussion of special education law would be complete without the fundamental understanding of every student’s right and entitlement to receive a free and appropriate education, better known as FAPE. Our skilled counsel focus on these fundamental ideals that are essential to the education of every student.

Dispute Resolution

We believe that consideration of alternative forms of dispute resolution such as negotiation, mediation and conciliation are essential to working collaboratively as much as possible and putting the student at the center – right where they should be.

Administrative Hearings

Our attorneys in our special education practice are experienced in representing clients in administrative hearings before the Bureau of Special Education Appeals also known as the BSEA or the Office of Civil Rights (“OCR”) of the U.S. Department of Education. The BSEA is often the first step in ensuring compliance with the student’s IEP and its obligations under both federal and state law. When necessary, we also represent clients in both state and federal court.

IEPs

We have the ability to focus and assist families with creating an IEP at the school level that best fits their student’s need for special education services that when done correctly, would allow that student to make effective process in accessing the curriculum. We have experience representing clients who require accommodations for standardized testing, professional licensure examinations and those clients who require accommodations in their college or graduate-level programs.

General Education Matters

In addition to our special education practice, our attorneys also provide advice and counsel to parents and students in general education matters such as enrollment, bullying and harassment, cyberbullying, social media issues, student mental health, behavior, and discipline (including suspension or expulsion), attendance, private school related matters and school investigations. Our practice includes representation in matters that may arise during a student’s enrollment at the collegiate level.
